This Acceptable Use Policy ("AUP") governs your use of the Waymaker platform and services provided by Waymaker One Pty Ltd ABN 84 613 256 429.

BY ACCESSING OR USING THE WAYMAKER PLATFORM, YOU AGREE TO COMPLY WITH THIS AUP. VIOLATIONS MAY RESULT IN IMMEDIATE ACCOUNT SUSPENSION OR TERMINATION WITHOUT REFUND.

1. Purpose and Scope

1.1 Purpose

This AUP protects the Waymaker platform, our users, and the broader internet community from abusive, harmful, or illegal activities. It defines acceptable behavior and sets clear boundaries for platform usage.

1.2 Scope

This policy applies to:

  • All Waymaker applications (Academy, Advisor, Commander, Help, Waymaker One)
  • All users (individual subscribers, organization members, partners, guests)
  • All content uploaded, created, or shared on the platform
  • All API usage and programmatic access

2. Acceptable Uses

2.1 Permitted Activities

You MAY use Waymaker for:

  • Document creation and sharing
  • Business analysis and reporting

✅ AI-Powered Services

  • Strategic guidance using Waymaker frameworks
  • Content generation and brainstorming
  • Task automation and workflow optimization

✅ Professional Communication

  • Internal team messaging and updates
  • External stakeholder collaboration (via guest access)
  • Client presentations and deliverables

3. Prohibited Activities

The following activities are STRICTLY PROHIBITED on the Waymaker platform:

3.1 Illegal Activities

  • Child sexual abuse material (CSAM) or child exploitation content
  • Terrorism, violent extremism, or hate speech
  • Drug trafficking, weapons sales, or illegal marketplace activity
  • Money laundering, financial fraud, or tax evasion schemes
  • Copyright infringement or piracy

3.2 Harmful Content

  • Harassment, bullying, threats, or doxxing
  • Sexually explicit content or pornography
  • Graphic violence or gore
  • Self-harm promotion or suicide encouragement
  • Malware, viruses, or malicious code

3.3 Security Violations

  • Hacking, unauthorized access, or account takeover attempts
  • Phishing, social engineering, or credential theft
  • Denial of service (DoS) or distributed denial of service (DDoS) attacks
  • Exploiting security vulnerabilities for malicious purposes

3.4 Platform Abuse

  • Creating fake accounts or impersonating others
  • Manipulating system features or bypassing restrictions
  • Automated scraping, crawling, or data extraction
  • Reselling or redistributing Waymaker services

3.5 Intellectual Property Violations

  • Uploading copyrighted content without permission
  • Trademark infringement or brand impersonation
  • Trade secret theft or confidential information leaks

3.6 Spam and Unwanted Communication

  • Bulk unsolicited messages or spam
  • Phishing emails or deceptive messages
  • Chain letters or pyramid schemes

3.7 Financial Abuse

  • Payment fraud, credit card theft, or chargebacks abuse
  • Ponzi schemes, get-rich-quick scams, or investment fraud
  • Token manipulation or credit abuse

3.8 AI-Specific Violations

  • Generating harmful, deceptive, or illegal content via AI
  • Attempting to extract or reverse engineer AI models
  • Using AI outputs to train competing AI systems
  • Bypassing AI content filters or safety mechanisms

4. Content Standards

4.1 User-Generated Content

You are responsible for all content you upload, create, or share on Waymaker, including:

  • Documents, files, and presentations
  • Task descriptions and project plans
  • Comments, feedback, and messages
  • AI prompts and generated content

4.2 Content Monitoring

Waymaker reserves the right to monitor, review, and remove content that violates this AUP, applicable laws, or our Terms of Service. Automated systems and human review may be used.

4.3 Content Removal

We may remove violating content without notice and may retain evidence for legal or safety purposes.

5. AI Services Acceptable Use

5.1 Permitted AI Use Cases

You may use Waymaker's AI features for:

  • Strategic planning and business consulting
  • Content generation and brainstorming
  • Task automation and workflow optimization
  • Data analysis and business insights
  • Document summarization and drafting

5.2 Prohibited AI Activities

You MUST NOT:

  • Generate harmful, deceptive, illegal, or unethical content
  • Attempt to extract or reverse engineer model training data
  • Use AI outputs to train competing AI models
  • Bypass content filters or safety mechanisms
  • Generate spam, misinformation, or manipulative content

5.3 AI Output Responsibility

You are responsible for reviewing and validating all AI-generated content. AI may produce inaccurate or biased outputs. Do not rely solely on AI outputs for critical business decisions.

5.4 Token Management

AI features consume credits/tokens. Abuse of AI features or excessive usage may result in restrictions.

6. Resource Usage Limits

6.1 Fair Use Standards

Waymaker is designed for professional business use with reasonable resource consumption. Fair use means:

  • Normal daily business operations
  • Typical team collaboration activities
  • Reasonable file storage and sharing
  • Standard API and integration usage

6.2 Storage Limits

Storage allocations by plan tier:

  • Individual: 10 GB per user
  • Business: 100 GB per organization
  • Enterprise: 1 TB per organization + custom allocations

Prohibited storage activities:

  • Using Waymaker as a file backup service
  • Storing pirated content or illegal files
  • Hosting files for external distribution
  • Circumventing storage limits via multiple accounts

6.3 API Usage Limits

Standard API rate limits:

  • Authentication: 10 requests/second
  • Data operations: 100 requests/minute
  • AI coordination: 20 requests/minute
  • File uploads: 10 MB/file, 100 MB/hour

Prohibited API activities:

  • Exceeding rate limits via distributed requests
  • Scraping data via automated API calls
  • Reverse engineering API endpoints

6.4 Bandwidth and Performance

Fair use expectations include normal page loads, file transfers, and real-time collaboration.

Prohibited bandwidth activities:

  • Denial of service (DoS) attacks
  • Flooding platform with requests
  • Running bandwidth-intensive operations without authorization

7. Security and Access

7.1 Account Security Requirements

You MUST:

  • Keep credentials confidential
  • Use strong, unique passwords
  • Enable multi-factor authentication (MFA) where available
  • Log out from shared devices
  • Report unauthorized access immediately

You SHALL NOT:

  • Share account credentials
  • Use another person's account
  • Bypass security controls
  • Exploit security vulnerabilities (without responsible disclosure)

7.2 Responsible Disclosure

If you discover a security vulnerability:

  • Report immediately to security@waymaker.io
  • Provide detailed reproduction steps
  • Do NOT exploit the vulnerability
  • Allow reasonable time for remediation (90 days)

We will acknowledge receipt within 24 hours and keep you informed of remediation progress.

7.3 Data Protection

You MUST:

  • Comply with applicable data protection laws (GDPR, Privacy Act, CCPA)
  • Only process personal data with legal basis
  • Report data breaches to Waymaker within 24 hours
  • Honor data subject rights (access, deletion, portability)

8. Reporting Violations

8.1 How to Report

If you observe AUP violations:

  • Date and time observed
  • Screenshots or evidence (if applicable)

Report types:

8.2 Investigation Process

Upon receiving a report:

  • Acknowledgment (24 hours) - Confirm receipt
  • Initial Review (48 hours) - Assess validity
  • Investigation (5-10 days) - Gather evidence
  • Action (varies) - Enforce policy if violation confirmed
  • Notification (varies) - Inform reporter and violator

We protect reporter identity where possible. Some disclosures may be required by law.

8.3 False Reports

Consequences of false or malicious reports:

  • Warnings for first offense
  • Account restrictions for repeat offenses
  • Account termination for deliberate abuse
  • Legal action for defamation or harassment

Good faith mistakes are NOT penalized.

9. Enforcement and Consequences

9.1 Enforcement Actions

Waymaker may take the following actions for AUP violations:

  • Email notification of violation
  • Deadline to comply (typically 7 days)
  • No account impact if corrected

🔒 Account Restriction (Moderate violation)

  • Temporary feature restrictions
  • AI features disabled
  • Duration: 7-30 days depending on severity

⏸️ Account Suspension (Serious violation)

  • Complete account access suspended
  • Data accessible for download (30 days)
  • Duration: 30-90 days
  • No refunds for subscription period

❌ Account Termination (Severe or repeat violations)

  • Permanent account closure
  • All data deleted after 30-day grace period
  • No refunds issued
  • Banned from creating new accounts

⚖️ Legal Action (Illegal activity)

  • Report to law enforcement
  • Civil litigation for damages
  • Criminal prosecution where applicable

9.2 Violation Severity Levels

Level 1: Minor (Warning)

Unintentional policy misunderstanding, low impact, first-time offense. Examples: Excessive storage, accidental spam.

Level 2: Moderate (Restriction or short suspension)

Intentional but not malicious violation, moderate impact. Examples: Persistent spam, resource abuse.

Level 3: Serious (Suspension)

Deliberate policy violation, significant impact. Examples: Security testing without authorization, content policy violations.

Level 4: Severe (Termination)

Malicious or harmful activity, illegal conduct, severe impact. Examples: Hacking attempts, fraud, harassment.

Level 5: Criminal (Legal action)

Illegal activity under criminal law, immediate threat to safety. Examples: CSAM distribution, terrorist content, financial fraud.

9.3 Factors Considered

We consider the following when determining enforcement action:

  • Severity and nature of violation
  • Intent (accidental vs. deliberate)
  • Impact on platform, users, and community
  • User's violation history
  • Cooperation with investigation
  • Remediation efforts

9.4 Appeals Process

If you believe enforcement action was incorrect:

1. Submit Appeal (within 30 days)

  • Email: appeals@waymaker.io
  • Subject: "AUP Enforcement Appeal - [Account Email]"
  • Include account information, description of enforcement action, reason you believe it was incorrect, and supporting evidence

2. Review Process

  • Acknowledgment within 48 hours
  • Independent review by senior team member
  • Review completed within 14 days

3. Possible Outcomes

  • Appeal upheld: Action reversed, access restored
  • Appeal partially upheld: Action reduced (e.g., suspension → restriction)
  • Appeal denied: Original action stands

Appeals are NOT available for criminal activity violations, CSAM or child safety violations, repeat severe violations (3+ terminations), or legal compliance enforcement.

9.5 No Refunds

Enforcement actions do NOT result in refunds:

  • Prepaid subscription fees are non-refundable
  • Unused AI tokens are forfeited
  • Applies to all enforcement levels (restriction, suspension, termination)

Exception: Enforcement determined to be in error via successful appeal.

10. Updates to This Policy

10.1 Changes

We may update this AUP to:

  • Address new types of abuse or violations
  • Comply with legal or regulatory requirements
  • Clarify ambiguous provisions
  • Reflect platform changes

10.2 Notification

Material changes will be communicated via:

  • Email to all registered users
  • Platform notification on next login
  • Updated "Last Updated" date
  • Version number increment (major change)

Minor changes (clarifications, formatting) will only update the "Last Updated" date without active notification.

10.3 Acceptance

Continued use after changes constitutes acceptance:

  • 30-day notice for material changes
  • Opportunity to terminate subscription without penalty
  • New version posted at waymaker.io/legal/acceptable-use
  • Previous versions archived for reference
